The second of two lawsuits filed against a planned Woodstock housing project has been dismissed, according to the Times Herald-Record and the Daily Freeman.
Once again, the plaintiffs have been foiled by a technicality, according to the THR:
State Supreme Court Judge Christopher Cahill ruled the lawsuit was filed too late. A group of seven petitioners filed the suit March 9, but it needed to have been filed by Sept. 10 last year — 30 days after the town Planning Board filed its resolution granting a permit, approving the site plan and finding that there was an adequate water supply.
We wrote about the first lawsuit against the Woodstock Commons project, which was dismissed by the same judge for a similar problem, back in April.
According to the Freeman, the plaintiffs are not going to be deterred by their multiple failures in court, but are considering filing yet another lawsuit.
