The Watershed Post is operated by Watershed Post, Inc., a New York corporation with headquarters in New Kingston, NY, 12459. By using our website and our services, you agree to our Terms of Service, our Privacy Policy, and our Reprint Policy, which are outlined on this page. If we make changes to either of these policies, we will post them here and on our homepage.

Terms of Service

By using this website, you agree that The Watershed Post is an “as-is” service, and that you use it at your own risk. You won’t hold us liable in the event that we change or terminate your relationship to the service, or do anything else that affects your experience on the site. We also won’t be held liable for inaccuracies, errors, or omissions in our information or any damages they may cause. While we will do our best to provide accurate and complete information, we do not guarantee the accuracy or completeness of what we post. 1. Conduct

You agree not to post, email, or otherwise make available content:

a) that is unlawful, harmful, threatening, abusive, harassing, invasive of another's privacy, or is harmful to minors in any way;

b) that is pornographic;

c) that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

d) that violates the Fair Housing Act by stating a discriminatory preference based on race, color, national origin, religion, sex, familial status or handicap;

e) that violates federal, state, or local equal employment opportunity laws by stating a preference or requirement based on race, color, religion,sex, national origin, age, or disability;

f) that impersonates any person or entity, unless it is an obvious parody

g) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

h) that disrupts the normal flow of dialogue or that otherwise negatively affects other users' ability to use Watershed Post, Inc.;

i) that employs misleading email addresses, forged headers or otherwise manipulated identifiers in order to disguise the origin of the content.

Additionally, you agree not to:

j) contact anyone who has asked not to be contacted;

k) “stalk” or otherwise harass anyone;

l)  attempt to gain unauthorized access to Watershed Post, Inc.'s computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, The Watershed Post website.

2. Premium Listings

Watershed Post, Inc. charges a fee to post content in some areas of The Watershed Post, including  premium directory listings and the Trading Post advertising channel. Users who subscribe to premium listings are bound by these Terms of Service. All fees paid will be non-refundable in the event that content is removed from the website for violating the Terms of Service.

3. Termination of Service

You agree that Watershed Post, Inc., in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the website  (or any part thereof), immediately and without notice, and remove and discard any content within the website, for any reason, including, without limitation, if Watershed Post, Inc. believes that you have acted inconsistently with the letter or spirit of the Terms of Service. Further, you agree that Watershed Post, Inc. shall not be liable to you or any third-party for any termination of your access to the Service. 

4. Indemnity

You agree to indemnify and hold Watershed Post, Inc., its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of content you submit, post or make available through the website, your use of the website, your violation of the Terms of Service, your breach of any of the representations and warranties herein, or your violation of any rights of another.

5. Participating in The Watershed Post.       

We encourage civility, lively debate and free speech in this community. But use your common sense when you publish material to The Watershed Post: You are responsible for what you contribute.  Watershed Post, Inc. is not responsible for any content contributed by its users and readers. You grant us the right to display and distribute what you submit to the site, and we also reserve the right to review, edit or delete any and all materials from the website any material at our discretion.  

6. Children

The Watershed Post is intended for individuals over the age of 13 years old. Personal information may not be provided by anyone under 13 years of age, and no one under 13 years old may participate in the comments sections, blogs, or other areas where public discussions may take place. In addition, no one under that age of 18 may conduct any transactions for the purposes or purchasing or selling any items. Parents should be sure that their children are not conducting any of the above activities on The Watershed Post.

Copyright Infringement

Watershed Post, Inc. respects the copyright and intellectual property rights of others. If you believe that content posted on our site violates copyright law, please send our copyright agent written notification of the claimed infringement. Your notification should include an explanation of what the infringing content is, a statement that you are either the copyright owner or that you are authorized to act on the owner’s behalf, and your contact information. Watershed Post, Inc. is committed to protecting the privacy of its community members and users. This privacy policy contains an explanation of what information we collect about you when you use our site and what we do with it. While we do reserve the right at any time to change what information we collect and how we use it, we will notify you of those changes here and on the website's home page. Users can change their privacy preferences through their My Account page on watershedpost.com or by contacting us at editor@watershedpost.com

Watershed Post, Inc. collects personally identifying information, such as your name and your email, when you register as a user on the site or subscribe to our emails. Some of content on The Watershed Post. site is unavailable unless you register. Watershed Post, Inc. may use this identifying information for internal analytical and business development purposes and to send you e-mails, but it will not sell or give this information to third parties without your permission. You can opt out of receiving our e-mails by clicking the appropriate links that appear at the bottom of e-mails you receive.

Public areas of the site include comments, discussion forums, chat rooms, blogs, directory pages, and the “public contact” areas of submission forms. In the event that the ownership of Watershed Post, Inc. or any of its products are sold or transferred, all lists and data which contains personally identifying information and data including for example user name, address, company name, telephone number, demographic information, buying information, other data and e-mail address, will be transferred to the new owner.
